1. Agreement to Terms

By accessing or using the Gibbits mobile application and website (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service.

These Terms constitute a legally binding agreement between you and Gibbits LLC ("Gibbits," "we," "us," or "our").

2. Eligibility

You must be at least 13 years old to use the Service. By using the Service, you represent and warrant that:

• You are at least 13 years of age
• You have the legal capacity to enter into these Terms
• You are not prohibited from using the Service under applicable law

3. Account Registration

To use certain features of the Service, you must create an account. You agree to:

• Provide accurate and complete information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized access
• Accept responsibility for all activity under your account

We reserve the right to suspend or terminate accounts that violate these Terms.

4. The Gibbits Points System

We reserve the right to modify the points system, including earning rates and point values, at any time.

5. User Content

You may post reviews, ratings, photos, and other content ("User Content") on the Service. By posting User Content, you:

• Grant us a non-exclusive, worldwide, royalty-free license to use, display, and distribute your User Content
• Represent that you own or have rights to the content
• Agree not to post content that is false, misleading, defamatory, or illegal

Prohibited Content

You may not post content that:

• Is false, fraudulent, or misleading
• Infringes intellectual property rights
• Contains hate speech, harassment, or threats
• Is obscene, pornographic, or sexually explicit
• Promotes illegal activities
• Contains spam or unauthorized advertising
• Impersonates another person or entity

We reserve the right to remove any content that violates these Terms.

6. Acceptable Use

You agree not to:

• Use the Service for any illegal purpose
• Attempt to gain unauthorized access to any part of the Service
• Interfere with the proper functioning of the Service
• Use automated systems or bots to access the Service
• Collect information about other users without consent
• Manipulate rankings or game the points system
• Create multiple accounts to abuse promotions or features

The Service and its original content (excluding User Content) are owned by Gibbits LLC and protected by copyright, trademark, and other intellectual property laws.

The Gibbits name, logo, and related marks are trademarks of Gibbits LLC. You may not use our trademarks without prior written permission.

8. Third-Party Services

The Service may contain links to third-party websites or services, including restaurant websites and mapping services. We are not responsible for the content, policies, or practices of third-party services.

9. Disclaimers

We do not guarantee that:

• The Service will be uninterrupted or error-free
• Information about restaurants is accurate or current
• User reviews and ratings are truthful or reliable

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GIBBITS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE.

Our total liability shall not exceed the amount you paid us (if any) in the 12 months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless Gibbits LLC and its officers, directors, employees, and agents from any claims, damages, or expenses arising from:

• Your use of the Service
• Your User Content
• Your violation of these Terms
• Your violation of any third-party rights

12. Termination

We may terminate or suspend your account and access to the Service at any time, with or without cause, with or without notice. Upon termination:

• Your right to use the Service ceases immediately
• We may delete your account and User Content
• Any Gibbits points will be forfeited

You may also delete your account at any time through the app settings or by contacting support.

13. Governing Law

These Terms shall be governed by the laws of the State of Colorado, without regard to conflict of law principles. Any disputes shall be resolved in the courts located in Denver County, Colorado.

14. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by posting the new Terms on this page and updating the "Last updated" date. Continued use of the Service after changes constitutes acceptance of the new Terms.
